Terms and conditions of sale.

Sale of books and scores, sale and hire of orchestral materials of the Ravel Edition — XXI Music Publishing ASBL.

01 Scope

These terms and conditions govern the sale of books and scores and the sale and hire of orchestral materials of the Ravel Edition, entered into between XXI Music Publishing ASBL, Place Communale 13, Boîte 2, 1630 Linkebeek (Belgium), company and VAT number BE 0687.982.002 (“the seller”), and any natural or legal person (“the customer”).

A “consumer” is a customer who is a natural person acting for purposes outside their professional activity. Any other customer — orchestra, institution, ensemble, bookseller, reseller… — is a “professional”.

Placing an order implies acceptance of these terms, in the version in force on the date of the order. Specific terms agreed in writing, in particular in a quotation or hire agreement, take precedence over these terms.

02 Products

The raveledition.com website presents the publications of the Ravel Edition; it is not an online shop. The products offered are:

  • books (hardback volumes) and the Vocal & Piano score;
  • orchestral materials (full score and parts), for sale or for hire. Some are available for hire only; the list is given on the Sales page.

Products are offered subject to availability.

Territorial restrictions. For copyright reasons, some editions cannot be sold or hired in certain territories. At present, the revised edition of L'Enfant et les sortilèges is not available in France, Spain and Mexico, and Bolero remains protected in certain territories, including the United States. It is the customer's responsibility to ensure that the products ordered may be imported and used in their country.

03 Ordering

Books and scores. Orders are placed by email to sales@21-music.be, stating surname, first name, email address, country and full postal address. The seller sends an acknowledgement stating the total amount, including shipping, and the payment details. The sale is concluded on receipt of payment, confirmed by email.

Orchestral materials. Sale and hire are on quotation, to be requested from sales@21-music.be. The order becomes binding once the customer accepts the quotation in writing.

The seller may refuse an order in the event of a previous payment dispute, or where delivery is impossible because of the territorial restrictions set out in article 2.

04 Prices and VAT

Prices are expressed in euros. They are shown excluding VAT, with the amount including VAT given for information.

Belgian VAT at 6% applies to customers who are natural persons and to legal persons without a valid intra-Community VAT number.

Shipping costs are added to the price, according to the rates published on the Sales page. For countries outside the European Union, they are quoted on request; any customs duties and import taxes are payable by the customer.

The price invoiced is the price in force on the date of the order.

05 Payment

Payment is made by bank transfer or PayPal, using the details provided by the seller. Books and scores are shipped once payment has been received.

Invoices issued to professional customers (orchestras, institutions, resellers…) are payable within 30 days of issue, unless another period is stated on the invoice or quotation.

Professional customers: any invoice unpaid when due shall automatically and without notice bear late-payment interest at the rate set by the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, together with a fixed indemnity of 15% of the amount due, with a minimum of €50. Invoices are deemed accepted unless disputed in writing within eight days of receipt.

Consumer customers: in the event of late payment, the legal provisions applicable to consumers apply, including a prior free reminder.

06 Delivery

Shipments are made by carrier (UPS, DHL…), to a pick-up point or to the customer's address. Delivery times given are indicative; unless otherwise agreed, delivery takes place no later than 30 days after the sale is concluded.

For consumer customers, the risk of loss or damage passes on receipt of the goods. For professional customers, goods travel at the customer's risk from the time they are handed to the carrier.

07 Hire of orchestral materials

Hire covers complete sets (full score and parts). The hire period, the concerts or performances covered and the price are set out in the quotation or hire agreement.

Hired materials remain the property of the seller. They must be returned complete and in good condition by the agreed date. Markings are permitted in pencil only. Any reproduction of the materials, in whole or in part, is prohibited.

Missing or damaged parts, and any late return, may be invoiced in accordance with the hire agreement.

Declarations and fees relating to the public performance, recording or broadcasting of the works are the responsibility of the organiser, with the relevant collecting societies.

08 Retention of title

Goods sold remain the property of the seller until the price has been paid in full.

09 Right of withdrawal

Consumer customers have 14 days from receipt of the product to withdraw from the purchase, without giving any reason and without penalty.

They notify their decision by an unambiguous statement, by email to sales@21-music.be (subject: “Withdrawal” followed by the order number) or by post to XXI Music Publishing ASBL, Place Communale 13, Boîte 2, 1630 Linkebeek (Belgium). They then return the product, complete and in good condition, no later than 14 days after that notification; return costs are borne by the customer.

The seller refunds all sums paid, including the initial standard delivery costs, no later than 14 days after being informed of the withdrawal. The refund may be withheld until the product has been received or proof of its dispatch provided.

The right of withdrawal does not apply to professional customers, to materials made to the customer's specifications (for example a binding produced at their request), or to the hire of materials for an agreed date.

10 Guarantees

Consumer customers: products are covered by the two-year legal guarantee of conformity from delivery provided by the Belgian Civil Code. In the event of a lack of conformity, the consumer is entitled to repair or replacement of the product and, where these are impossible, to a price reduction or a refund.

Professional customers: any claim concerning an apparent defect or non-conformity must be notified in writing within eight days of receipt. The guarantee is limited to the replacement of products acknowledged to be defective.

11 Liability

The seller is bound by an obligation of means. It cannot be held liable for damage resulting from force majeure or from the use of the Internet, within the limits permitted by law.

Products comply with Belgian law. The seller cannot be held liable if their import or use is restricted by the law of the country of delivery (see article 2).

12 Personal data

Data provided when ordering is used solely to process and invoice the order. See our privacy policy.

13 Governing law and disputes

These terms are governed by Belgian law, without prejudice to any more protective mandatory provisions of the law of the consumer's country of residence.

In the event of a problem, the customer is invited to contact the seller first at sales@21-music.be to seek an amicable solution. Consumer customers may also apply free of charge to the Belgian Consumer Mediation Service, North Gate II, boulevard du Roi Albert II 8, box 1, 1000 Brussels — www.mediationconsommateur.be.

Failing agreement, and subject to the jurisdiction rules protecting consumers, the courts of the judicial district of Halle-Vilvoorde have sole jurisdiction.

14 Severability

If any clause of these terms is held void or unlawful, the remaining clauses remain fully applicable.
